Rubble of building STORYLINE: Lawyers for Khalfan Khamis Mohamed, accused of participating in the bombing of the US Embassy in Dar Es Salaam, launched an urgent application on Thursday in South Africa's highest court in a bid to stop him from being sentenced to death in America. He has been accused of conspiring with Osama Bin Laden to bomb the US Embassy in Dar Es Salaam in August 1998. Mohamed, a Tanzanian citizen living under an assumed name in South Africa was arrested and handed to the FBI who flew him to the US in October 1999 in an action his lawyers say was illegal. Mohamed is seeking an order from South Africa's Constitutional Court declaring his deportation unlawful and compelling the South African government to request that the court in New York City does not impose the death penalty on him or alternatively does not carry it out. Six days of closing arguments in the 3 month long trial concluded on Wednesday and it is expected that the jury will begin deliberations on Friday. The trial centres on four men who are accused of carrying out both the Dar Es Salaam bombing and the near-simultaneous attack on the US embassy in Nairobi . The defense attorneys argued their clients were victims of guilt by association with exiled Saudi millionaire Osama bin Laden. An indictment charges the defendants with joining a terrorist plot by bin Laden to drive U.S. forces out of the Middle East by killing Americans everywhere. The alleged conspiracy included the near-simultaneous August 7, 1998, attacks on embassies in Kenya and Tanzania, which left 224 people dead, including 12 Americans, 201 Kenyans and 11 other Africans. Defence attorneys portrayed Mohamed as a pawn in a scheme he knew nothing about. There are currently seventy-six members in the House of Representatives in Zanzibar, including fifty elected by the people, ten appointed by the president of Zanzibar, five ex officio members, and an attorney general appointed by the president. In May 2002, the government increased the number of special seats allocated to women from ten to fifteen, which will increase the number of House of Representatives members to eighty-one. Ostensibly, Zanzibar's House of Representatives can make laws for Zanzibar without the approval of the union government as long as it does not involve union-designated matters. The terms of office for Zanzibar's president and House of Representatives also are five years. The semiautonomous relationship between Zanzibar and the union is a unique system of government. Tanzania has a five-level judiciary combining the jurisdictions of tribal, Islamic, and British common law. Appeal is from the primary courts through the district courts, resident magistrate courts, to the high courts, and Court of Appeals. Judges are appointed by the Chief Justice of Tanzania, except those for the Court of Appeals and the High Court who are appointed by the president. The Zanzibari court system parallels the legal system of the union, and all cases tried in Zanzibari courts, except for those involving constitutional issues and Islamic law, can be appealed to the Court of Appeals of the union. A commercial court was established in September 1999 as a division of the High Court.
